Kenneth M. Berner

Mr. Berner's practice is primarily directed to patent and trademark matters, including preparing and prosecuting patent application and counseling clients on issues relating to enforcement and infringement of intellectual property rights.
Mr. Berner has experience in preparing and prosecuting computer software applications. These applications have been primarily directed to relational databases and object oriented programming. Mr. Berner has also had significant experience prosecuting patent applications in the telecommunications field for wireless TDMA devices, and for analog and digital signal processing techniques used in wireless systems. He also has prepared many complex mechanical applications. Mr. Berner also has extensive experience in prosecuting patent applications that are the subject of ongoing litigation and successfully obtained allowance of continuation applications. He has worked closely with foreign associates in obtaining patent protection for U.S. clients in countries around the world including Europe, Germany, and Japan including opposing and instituting oppositions in Germany, Sweden, and Japan.
Mr. Berner holds a degree in mechanical engineering from Union College, a master's degree in business administration from Butler University and a Juris Doctor degree, cum laude, from Indiana University. Prior to entering the legal profession, he worked for nearly ten years as an engineer and is a registered Professional Engineer in Indiana. Mr. Berner is the author of several articles related to patent law. He is admitted to practice in Virginia, for the Federal Circuit and the U.S. Patent and Trademark Office. Mr. Berner's professional associations include the American Bar Association and the American Intellectual Property Law Association.
